DMCA and Copyright Policy

1. Commitment to Intellectual Property

Coursepacker respects the intellectual property rights of others. We comply with the Digital Millennium Copyright Act (DMCA) and expect our users to do the same. We will respond promptly to notices of alleged infringement that comply with applicable law.

3. How to File a Takedown Notice

To file a DMCA takedown notice, you must provide ALL of the following (per 17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the material on Coursepacker that is allegedly infringing, with enough detail to locate it (e.g., case title, URL).
  4. Your contact information: name, address, telephone number, and email.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

We aim to acknowledge receipt within 2 business days and process the notice within 10 business days.

4. Counter-Notification Procedure

If your content was removed and you believe it was wrongly identified as infringing, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement consenting to jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the US, any judicial district in which Coursepacker may be found).
  6. A statement that you will accept service of process from the person who submitted the original takedown notice.

If we receive a valid counter-notification, we will forward it to the original complainant and restore the material within 10–14 business days unless the complainant files a court action.

5. Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service, Coursepacker maintains a policy to terminate accounts of repeat infringers.

Three verified infringement notices against the same account within a rolling 12-month period will result in permanent account termination.

Account termination includes removal of all authored content and forfeiture of unpaid earnings.

We reserve the right to terminate accounts with fewer than three notices in egregious circumstances.

6. Good Faith and Misrepresentation Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.

Please consider whether the material constitutes fair use before filing a notice.

We encourage copyright owners to contact the alleged infringer directly before filing a formal DMCA notice to resolve disputes informally.
